Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Zenith: Fitness & Nutrition app and website (the “Service”), operated by J&O Sales LLC (“Zenith,” “we,” “us”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Additional Disclosures. If you don't agree, don't use the Service.

1. Eligibility & age

You must be at least 13 years old to use Zenith. If you are between 13 and 18 (or the age of majority where you live), you may use Zenith only with the involvement and agreement of a parent or legal guardian, who accepts these Terms on your behalf. Zenith is not intended for children under 13.

2. Your account

You're responsible for the accuracy of the information you provide, for keeping your login secure, and for activity under your account. Notify us at support@josalesllc.net of any unauthorized use.

3. Subscriptions, billing & refunds

Zenith offers a free tier and paid Premium plans: Monthly ($9.99), Yearly ($69.99), and a one-time Lifetime purchase ($139.99). Coaching plans are sold separately on our website.

Where you buy: Premium can be purchased through the Apple App Store / Google Play (in-app purchase) or on our website via Stripe. Coaching plans are website-only.
Auto-renewal: Monthly and Yearly subscriptions renew automatically at the then-current price until cancelled. You can manage or cancel anytime — in your App Store/Google Play account settings for in-app purchases, or via the billing link/our support for website subscriptions. Cancelling stops future renewals; it doesn't retroactively refund the current period.
Refunds: purchases made through Apple or Google are subject to their refund policies. Website purchases are handled by us; except where required by law, payments are non-refundable.
Lifetime: “Lifetime” means access to Premium for the operational lifetime of the Zenith Service — for as long as Zenith remains available. It is not a guarantee that the app or any feature will exist in perpetuity and does not refer to a user's lifetime. If the Service is permanently discontinued, lifetime access ends then. Lifetime is a one-time, non-recurring payment and is non-refundable except where required by law.

4. Acceptable use & user content

Zenith includes community features that let you post messages, comments, photos, and feed posts (“User Content”). You are solely responsible for your User Content and must have the rights to share it.

No objectionable content. You agree not to post content that is unlawful, harassing, abusive, hateful, threatening, defamatory, obscene, sexually explicit, or that infringes others' rights. There is zero tolerance for objectionable content or abusive behavior.

Moderation. We may (but aren't obligated to) review, remove, or restrict User Content at our discretion and without notice, and may suspend or terminate accounts that violate these Terms. You can report content or block users with the in-app tools. By posting User Content you grant us a non-exclusive, royalty-free license to host, store, and display it to operate the Service.

5. Private communities

When you join a private community, its owner can view the fitness and nutrition information you log so they can coach and support you. They cannot see your login credentials, password, or payment details. You choose whether to join and can leave at any time. See our Additional Disclosures for details.

6. Not medical advice; figures are estimates

Zenith provides general fitness, nutrition, and wellness information, including AI-generated meal plans, workout suggestions, and supplement guidance. This is for informational purposes only and is not medical, nutritional, or professional health advice, and not a substitute for a qualified physician, dietitian, or healthcare professional. Always consult a professional before starting any diet, exercise, or supplement program, especially if you have a medical condition, are pregnant, or take medication.

Activity, route, calorie, pace, and health-related figures (including data from Apple Health and estimates derived from GPS or workouts) are estimates for informational and fitness-tracking purposes only. You use this information at your own risk.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding your User Content), is owned by J&O Sales LLC and protected by law. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. You may not copy, reverse-engineer, resell, or misuse it.

8. Disclaimers & limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, J&O Sales LLC is not liable for any indirect, incidental, or consequential damages, or for any outcome resulting from your reliance on the Service or its information; our total liability is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users.

10. Governing law & changes

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules. We may update these Terms from time to time; we'll revise the “Effective date” and, for material changes, provide additional notice. Continued use after an update means you accept the revised Terms.
